Please find below a brief update on:

Commercial Law: Some changes were made to the Law “On Mediation” (Note: originally the Law “On Mediation” was adopted on March 29, 2019). This Law was meant to regulate certain types of public relations, specifically mediation as one of alternative methods to assist in dispute resolution.  With these new amendments, initial mediation process became no longer compulsory in commercial disputes. Effective immediately any commercial disputes (including disputes with foreign presence) may be still resolved with the use of mediators but only voluntarily, without any obligation and with mutual consent of parties.

Labour Law: Other considerable changes have been made to the Labour Code of Azerbaijan regarding certain categories of employees. For instance pregnant women, women with children under the age of 14, women with disabled children under age of 18, single father bringing up a child under the age of three may be engaged in nightshift work, overtime work, work on holidays and weekends as well as other days considered as non-business days in Azerbaijan or engage them in business travel only on the basis of their written consent. Furthermore, under certain circumstances, doctor’s certificate along with written consent may be required. 

Judicial System: On January 25, 2024, the Law “On arbitration” was adopted. This Law is meant to regulate public relations arising in connection with the implementation of arbitration, determine the requirements for arbitration agreement, organization and operation of arbitration courts and permanent arbitration organizations in the Republic of Azerbaijan, conduct of arbitration proceedings, recognition and enforcement of arbitration decisions.  The relevant amendments in relation with newly adopted Law “On Arbitration” have been made to the Civil Procedure Code and other related legal acts of the Republic of Azerbaijan.
