UZB - CHANGES TO MIGRATION RULES

On February 7, 2024 new Resolution of the Cabinet of Ministers of the Republic of Uzbekistan "ON APPROVAL OF THE REGULATION ON THE PROCEDURE OF ACCREDITATION AND ACTIVITY OF REPRESENTATIVE OFFICES OF FOREIGN COMMERCIAL ORGANIZATIONS ON THE TERRITORY OF THE REPUBLIC OF UZBEKISTAN"  (No. 76 ) was adopted, and  will come into force from May 7, 2024.

Previous Resolution of the Cabinet of Ministers No. 410 dated October 23, 2000 regulated procedure of the accreditation of the foreign employees of a representative office no longer has legal force.

According to the new Resolution, the following amendments have been envisaged:

1. The maximum number of foreign employees at a Representative office is increased from 3 (three) to 5 (five) employees;

2. The period of consideration of the application is reduced from 10 (ten) days to 5  (five) days;

3. The applications will be processed either via unified governmental portal (with electronic signature of the employer) or in person through public service centers (based on the power of attorney);

4. The requirement of attaching the police registration paper has been enacted;

5. If the foreign employee enters into part-time employment contract with another entity other than the Representative office, there is need for obtaining separate Work permit in the prescribed order for the foreign employee.

There has been a further amendment to the police registration requirements for Azerbaijani nationals. Thus, starting from January 15, 2024 citizens of the Republic of Azerbaijan can travel without police registration within 15 (fifteen) calendar days pursuant to the Protocol dated August 22, 2023 between the Government of the Republic of Uzbekistan and the Government of the Republic of Azerbaijan “On making additions and amendments to the agreement between the Government of the Republic of Uzbekistan and the Government of the Republic of Azerbaijan on visa-free travel of citizens of the Republic of Uzbekistan and the Republic of Azerbaijan dated June 18, 1997. It means that as of January 15, 2024 Azerbaijani nationals staying in Uzbekistan for more than 15 days shall be registered with the Police Department within 15 days upon their arrival to Uzbekistan.
